Individuals can benefit from attractive tax treatment when acquiring artworks. Upon resale, capital gains on artworks are typically tax-exempt if the artwork has been held for more than 12 years. If sold before this period, a progressive tax reduction applies to capital gains starting from the second year of ownership, gradually reducing the tax liability.
For Businesses:
French companies can also leverage tax benefits when investing in artworks. Companies subject to corporate tax (IS) can deduct the acquisition cost of original works by living artists from their taxable income, under specific conditions. This tax deduction is spread evenly over five years, at a rate of 20% per year, provided that the artworks are displayed in a public or employee-accessible location, excluding their offices.
